General Terms and Conditions for Continuing Education, Integration and Creative Courses at the IBZ-Bielefeld

1. scope

1.1 This General Terms and Conditions (GTC) applies to all contracts between the Internationale Begegnungszentrum Friedenshaus e.V. (hereinafter referred to as the organizer) and its customers* for participation in political and general further education, integration and creative courses.
*All personal names apply equally to all genders.

*The political education courses organised by the organiser serve to educate customers and enable them to form their own political opinions. Within the framework of the promotion of political education and the democratic state system, this is done in intellectual openness, i.e. in principle objectively and neutrally. Continuing education is limited to educational policy issues. The courses are not used to influence the formation of political will and public opinion in the sense of own opinions.

1.2 Customers within the meaning of these GTC are exclusively consumers.

A ‘consumer’ is any natural person who enters into a legal transaction for purposes which are predominantly not attributable to his commercial or self-employed professional activity (§ 13 BGB).

1.3 These GTC are available on the homepage at www.ibz-bielefeld.de under the menu item ‘GTC’. It is possible to save or print the GTC using the ‘Save’ or ‘Print’ button.

1.4 In addition, the General Terms and Conditions will be sent to the customer upon request of a course registration form and at the latest upon issuance of the registration confirmation by the organizer in

1.5 Children's and youth courses are excluded from the scope of these GTC.

2. Conclusion of contract

2.1 The presentation of the courses on the homepage at www.ibz-bielefeld.de or the blackboard does not constitute a legally binding offer of the organizer, but serves to provide information about the range of services and to submit a binding offer by the customer.

2.2 Written registration is required for participation in the courses described in section 2.1. The customer can use the online registration form provided on the website of the organizer.
In order to use the respective online form, the customer must first click on the tab of the desired course offer in order to access the form query. Into the
Name, contact details (e-mail, telephone, address), course number and bank details are entered in the form fields. The customer shall ensure the accuracy of his/her information on the activation of the checkbox (hereinafter referred to as ‘setting a checkbox’) to confirm the data entered. Furthermore, in order to continue the booking process, the customer is obliged to agree to the General Terms and Conditions and the Privacy Policy by ticking the box. The customer completes the registration process by clicking on the ‘book for a fee’ button. Until this time, the customer can view any input fields of his inputs by carefully reading and correcting them by overwriting the information in the respective form field via the usual keyboard and mouse functions. An effective technical means for better detection of input errors can be the enlargement function of the browser, which allows the customer to enlarge the presentations on the screen.
If the customer does not click the ‘book for a fee’ button, registration will not be possible and the process will be cancelled.
By sending the completed and signed course registration form, the customer makes a binding offer to the organizer for the conclusion of the contract. The customer is bound to his offer for 7 days.
A contract between the customer and the organiser is only concluded upon receipt of a confirmation of registration by the organiser to the customer. The registration confirmation takes place immediately after the organizer has checked the available free capacities of the selected course and has made a review and recording of the completeness and correctness of the information provided by the customer in the course registration form. As a rule, the registration confirmation is sent within 7 days via e-mail.

2.3 Furthermore, registration may be made by telephone or in person at the organizer's office. Registration for integration courses is exclusively in person at the office of the
Organizer possible.
If the type of registration requires the sending of the registration confirmation to the customer and the customer does not have any peripherals suitable for receiving e-mail messages, the registration confirmation will be sent to the customer by post.

2.4 Only the German language is available for the conclusion of the contract.

2.5 The text of the contract is stored digitally by the organizer (on the server of the organizer) and sent to the customer by e-mail after conclusion of the contract.
If the type of registration requires the dispatch of the contract to the customer and the customer does not have any periphery suitable for receiving e-mail messages, the contract will be sent to the customer by post.
When a contract is concluded in the organizer's office, the contract is handed over to the customer on a physical print medium.

3. prices; Reductions

3.1 The prices stated on the homepage and the black board of the organizer for the respective courses apply. These include statutory value-added tax. For a personal registration, a corresponding price list is available at the organizer's premises.

3.2 Students, persons with benefits from the SGBII, SBGXII or AsylbLG (holders of the Bielefeld Pass) and persons who are in possession of a severely disabled ID card receive

4. Terms of payment

4.1 Only the SEPA direct debit method is available to the customer as a payment method. No further costs are incurred for this (with the exception of any fees incurred by the customer's bank for this type of payment).

4.2 The registration form must be accompanied by a completed and signed form for the issue of the direct debit mandate.

4.3 The course fee is due 4 weeks before the start of the course and will be collected accordingly by the organizer.

4.4 If the course registration takes place less than 4 weeks before the start of the course, the course fee is due for payment immediately and collected by the organizer.

4.5 If the customer revokes the direct debit authorisation already granted or if the direct debit fails (e.g. due to a lack of funds in the customer's bank account), the customer shall bear the

5. Requirements for participation; Change of course

5.1 Prerequisite for the course participation is the existence of a valid contract and (if the course is subject to a charge) the full payment of the course fee before the start of the course.

5.2 Only the customer named in the registration confirmation is entitled to participate. A transfer of the contract to a third party is only possible after prior written agreement

6.2 The courses generally take place as a face-to-face event. If necessary, online courses are also offered.

6.3 In cases of force majeure, natural disasters, pandemics or closures due to official orders, selected face-to-face events will be switched to online courses. This does not apply to dance classes.

6.4. The course content, location and leader as well as the time is determined by the organizer and results from the respective course description. The organizer reserves the right to change the course content, course leader and location as well as the time, if this is reasonable for the customer taking into account the interests of the organizer. The customer is not entitled to a specific lecturer.

6.5 The organizer is entitled to keep an attendance list.

7. non-teaching days; outage

7.1 During the school holidays, the courses offered by the organizer do not take place, unless expressly stated otherwise.

7.2 The organizer reserves the right to cancel courses due to illness or other justified cases. If no alternative date can be offered, the customer will receive a corresponding refund for the course fee.

8. Certificate of participation

8.1 A certificate of participation will only be issued if the customer has at least 80% The course time was present.

8.2 For the subsequent issue of certificates/replacement receipts, the organizer charges a processing fee of 2.00 euros.

9. termination; Cancellation

9.1 Cancellation must be made in writing. The same applies to cancellations before the start of the course. The mere absence from a course is not considered a cancellation.

9.2 If a cancellation is made up to 14 days before the start of the course, the course fee will be refunded minus a processing fee of 5 euros.

9.3 The above provisions shall not apply if the customer makes effective use of his right of withdrawal. In this case, no cancellation fee will be charged.

10. liability

10.1 The liability of the organizer is limited to gross negligence and intent.

10.2 Other liability, in particular liability for third-party fault in accordance with §§ 276, 278 BGB, is excluded, unless the law provides otherwise.

10.3 The organizer makes every effort to provide truthful and complete information on its website. Nevertheless, no liability or guarantee is assumed for the completeness, up-to-dateness and correctness of the information provided.

11.1 The organizer reserves the right to collect and store the customer's data necessary for the business transaction. The processing of personal data takes place in compliance with the applicable data protection regulations for the purpose of contract processing with the customer. Upon conclusion of the contract, the customer agrees to the collection, use and processing of his personal data. The customer data will only be used for the purpose of the agreed performance and will not be passed on to third parties - or only with the express consent of the customer, which can be revoked at any time.

11.2 Upon request, the customer receives information at any time about the personal data stored about him.

12.2 There are no separate codes of conduct not set out in these GTC,

13. Final provision

13.1 Should one or more provisions of these GTC be invalid, the remaining provisions of the contract shall remain valid. The invalid provision shall be replaced by the statutory
provision.

13.2 The organizer is not willing and not obliged to participate in dispute resolution proceedings before a consumer arbitration board.

13.3 The law of the Federal Republic of Germany shall apply. The place of jurisdiction is Bielefeld.

14. withdrawal

If the contract is concluded via a means of telecommunication (online registration form, e-mail, telephone), the customer is a consumer within the meaning of § 13 BGB (German Civil Code) in accordance with

14.1 Exclusion

14.1.1 In accordance with § 312g (1), (2) sentence 1 no. 9 BGB, the right of withdrawal does not apply to contracts for the provision of services by the organiser that are in connection with leisure activities if the contract provides for a specific date or period of time for the provision.

14.1.2 The right of withdrawal expires in the case of a contract for the delivery of digital content (digital online courses) that is not on a physical data carrier, if the organizer has begun the execution of the contract after the customer has expressly agreed that the organizer begins the execution of the contract before the expiry of the withdrawal period, and the customer has taken note that he loses his right of withdrawal through his consent with the beginning of the execution of the contract.

14.2 Cancellation policy

Consequences of revocation
If you withdraw from this contract, we will have to pay you all the payments we have received from you, including the delivery costs (with the exception of the additional costs arising therefrom).
